National loan servicer Navient Solutions, Inc. (formerly Sallie Mae Inc.) agreed to pay $19.7 million after a class action lawsuit for violating the Telephone Consumer Protection Act (TCPA). Navient was charged with making thousands of automated voice calls to the wrong number.
Navient Solutions repeatedly autodialed consumers that allegedly owed them student loan payments; however, there were thousands of cases in which the phone number did not belong to the intended recipient, therefore violating 47 U.S.C. § 227 under the TCPA.
Navient Solutions agreed to pay $19.7 million to settle existing claims related to illegal calls and texts made between May 4, 2011, and January 6, 2017. The attorneys who represent the plaintiffs state that individual members of the class that filed claims may receive anywhere from $200 to $350.
This is only one of a few class action lawsuits against Navient Solutions, but the student loan provider continues to deny wrongdoing.
Dozens of large corporations violate the TCPA on a regular basis, but few consumers take action against these businesses. The TCPA has strict rules and regulations that apply to companies of all sizes, and violations are unlawful. Navient Solutions repeatedly broke the laws stated in the TCPA by dialing wrong numbers that did not belong to the intended recipients.
The TCPA was created to protect consumers from harassment by robocalls. Companies may only contact you via autodialing software if you have previously given them your written consent. Additional TCPA violations include (but are not limited to):
