Parking Tickets and Toll Fines: A Scam

A message out of the AG’s office in Columbus warns residents throughout Ohio that a recent spam text campaign involving parking tickets and toll fines is making the rounds. Because these texts are designed to cheat recipients out of their money, they cross the line from spam to scam.

Scams like these rely on instilling fear in recipients by focusing on the urgency of payment. Scam operations like this one have become far more sophisticated, and the documents attached may appear official. The State of Ohio, however, does not address parking tickets or toll fines in texts. The federal law that stands between your peaceful life and that never-ending stream of spam texts is the Telephone Consumer Protection Act (TCPA). This act places important restrictions on telephone solicitations, including those sent by text.

The same rules apply if the text is sent by a massive retailer or by a mom-and-pop from down the block. When a company sends a solicitation or informational text via an auto-dialer or in bulk to a consumer’s cell without their explicit permission, it is on the wrong side of the law. Further, when a consumer files a claim regarding an offending text, the company bears the burden of proving that it had the right to send it.

While many businesses lay claim to ownership of the phone numbers they collect, this doesn’t mean they have the right to send texts to the numbers. To send a marketing text through an automated system, the company must have prior express written consent. This is a high legal bar that many businesses sending spam texts are unable to clear.
