The federal law that stands between your peaceful life and that never-ending stream of spam texts is the Telephone Consumer Protection Act (TCPA). This act places important restrictions on telephone solicitations, including those sent by text.

Further, when a consumer files a claim regarding an offending text, the company bears the burden of proving that it had the right to send it.
While many businesses lay claim to ownership of the phone numbers they collect, this doesn’t mean they have the right to send texts to the numbers. To send a marketing text through an automated system, the company must have prior express written consent. This is a high legal bar that many businesses sending spam texts are unable to clear.
