How to Stop Unwanted Calls and Text Messages

The National Do Not Call Registry was created to stop unwanted sales calls and it’s free to register your home phone or cell phone. Rather than allowing these intrusions to continue, Congress enacted the Telephone Consumer Protection Act of 1991 (TCPA). U.S. Sen. Fritz Hollings, D-SC, the original bill’s sponsor, remarked that indiscriminate calls “are the scourge of modern civilization.  They wake us up in the morning; they interrupt our dinner at night; they force the sick and elderly out of bed; they hound us until we want to rip the telephone right out of the wall …. These calls are a nuisance and an invasion of our privacy.”

If you’re sick of receiving calls and text messages from any number of solicitors, you have legal protections. The TCPA also covers text messages and robocalls. Current TCPA regulations prohibit businesses from making automated, pre-recorded calls without written consent from those on the receiving end. The law permits any “person or entity” to bring an action to enjoin violations of the statute and/or recover actual damages or statutory damages ranging from $500 to $1,500 per violation. Many companies have lost in court and been required to pay huge sums to plaintiffs who were wronged. 

What to Do If You Receive Unwanted Calls and Texts

If you’re receiving unwanted texts and voicemails, save them so they can be reviewed by an attorney. These can be used as evidence in a settlement or in court. You should also make a log of all unwanted telephone calls so they can be reviewed for any potential violations. 

Last but not least, tell the unsolicited callers to stop calling you or direct their calls to your lawyer. Legally, they must refrain from continuing to contact you if you ask them to stop or if your lawyer does.
