There are protections in place at both the state and federal levels that help shield consumers from the waves of spam texts out there.

Pennsylvania’s Telemarketer Registration Act

Consumers in Philadelphia and throughout Pennsylvania are afforded protections by the state’s Telemarketer and Registration Act (TRA). This act extends anti-solicitation rules and restrictions, as well as those that apply to the Do Not Call Registry,y to unsolicited text messages that are sent prior to obtaining consent. Those commercial enterprises that violate the rules can face harsh civil penalties.

The National Telephone Consumer Protection Act

The federal Telephone Consumer Protection Act (TCPA) is a federal law that applies careful limitations to unsolicited calls and texts. Ultimately, businesses are required to obtain consent before blasting consumers with spam texts, and those who fail to do so can face financial consequences.

Consumer Rights

In order to send you autodialed promotional messages, the commercial company in question must obtain prior consent from you in writing. If you have already provided consent, however, the matter does not end there. Consumers have the right to revoke their consent at any time, and businesses are required to honor all such revocations. After you notify the company that you are opting out, their text communication should be limited to one text that confirms your change of mind.

It is important to note that responding to a spam text with any of the following words qualifies as a legally binding means of revoking your consent:

  • Stop
  • Cancel
  • End
  • Quit
  • Unsubscribe

If the company does not honor your revocation of consent, you can hold them legally liable.  

Holding the Company Liable

TCPA allows consumers who receive illegal spam texts to hold the offending companies financially responsible. This includes $500 per illegal text, which can increase to $1,500 per message if the company knew they were violating the law. Further, class action suits can apply to mass spam texting campaigns, which can lead to settlements and court awards in the millions.
