Can Businesses Call You on the Do Not Call Registry?

If you are on the National Do Not Call Registry, businesses that do not meet specific requirements are not allowed to call you. The Limitations of the Do Not Call Registry

If your name and number are included on the National Do Not Call Registry, it affords you considerable rights, but it doesn’t mean that all businesses are barred from calling you.

The Calls Are Not from a Telemarketing Company

Some businesses and organizations are exempt from the reach of the Do Not Call Registry. These include all the following:

  • Nonprofit organizations
  • Companies that are conducting surveys
  • Political campaigns
  • Informational calls that are not related to telemarketing
  • Calls made for emergency purposes

You Have an Established Business Relationship with the Company

If you have done business with the company within the last year and a half, such as making a purchase or payment, or receiving a delivery, they are exempt from the do-not-call requirements. The same is true if you made an inquiry or submitted an application to the company within the last three months.

If you gave the company your express written consent to call, such as through a text or email, they have the right to do so. This consent can, however, be revoked.

The Telephone Consumer Protection Act

Even those telemarketing and autodial companies that have the right to call you must follow the rules set forth by the Telephone Consumer Protection Act, which include all the following:

  • Limiting their call hours to between 8 AM and 9 PM
  • Ensuring that the caller identifies themself and the company and provides legitimate contact information
  • Limiting call-abandonment rates to no more than 3 percent over a 30-day period

Those companies that ignore the Do Not Call Registry, or that otherwise overstep call restrictions, can be held legally responsible. This translates to a specific fine per violation, which can add up quickly.
